1. About these terms
These Terms & Conditions ("Terms") govern your use of the KickFund website and application (the "Service"), operated by KickFund LLC ("KickFund," "we," "us"). By creating an account or making a contribution through the Service, you agree to these Terms.
2. The Service
KickFund is a fundraising platform for youth sports leagues. Donors contribute a per-point dollar amount tied to a team's game or competition results; team administrators post results; and the Service calculates points earned and the corresponding contribution. KickFund facilitates these contributions and related notifications. We are not a sports league, team, or charity and do not control how teams use funds raised. Contributions made through the Service are not charitable donations and are not tax-deductible.
3. Eligibility and accounts
You must be at least 18 years old to create an account or make a contribution. You are responsible for keeping your account credentials secure and for all activity under your account. Team administrators are responsible for the accuracy of the rosters, scores, and placements they enter.
4. Contributions
A contribution authorizes KickFund to charge your payment method for contributions calculated from team results, up to the per-game or per-competition cap shown when you set up the contribution. You may cancel a contribution at any time before the applicable points are earned, as described in our Refund & Cancellation Policy. KickFund LLC is the merchant of record for all contributions made through the Service: we charge your payment method, and the charge will appear on your statement under a KickFund descriptor. Payment processing is provided by Stripe and is subject to Stripe's terms. KickFund disburses funds raised to the designated team and is responsible for handling billing inquiries, refunds, and disputes relating to contributions.
5. Fees
KickFund may charge a platform fee on contributions and pass through standard payment-processing fees. All applicable fees are disclosed before you complete a contribution. See our Pricing page.
6. Acceptable use
You agree not to misuse the Service, including by submitting false information, attempting to defraud donors or teams, interfering with the Service's operation, or using it for any unlawful purpose.
7. Youth athlete information
Teams may add player information to track results. Publicly visible pages display only abbreviated player names to protect the privacy of minors. See our Privacy Policy for details.
8. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, KickFund is not liable for indirect, incidental, or consequential damages arising from your use of the Service. KickFund's total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total platform fees you paid to KickFund in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages; in those jurisdictions, our liability is limited to the greatest extent permitted by applicable law. Nothing in these Terms limits or excludes liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited or excluded under applicable law.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for violations of these Terms or to comply with legal requirements.
10. Changes and governing law
We may update these Terms from time to time; material changes will be posted here with a new effective date. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction, except where applicable law gives you the right to bring claims in the courts of your home state.
